The labour market in Australia is in a state of dramatic change. Traditional employment positions have been in decline, while flexible non-traditional and “gig economy” forms of work are on the rise. The Fair Work Ombudsman has recently filed its landmark prosecution against food delivery service, Foodora. The case follows significant attention and litigation around the characterisation of independent contractors, including in unfair dismissal claims lodged against Uber on the basis that its drivers are employees.
